Ah, yes. I said I wasn't good as a language lawyer!

I tend to agree with Robert that this ought to be disallowed. Unless 
someone else comes up with a reason otherwise, it would make a good 
interp request.

I note that the Intel compiler is one that gets an ICE for this - I will 
let them know.
